These Terms of Use ("Terms") govern your access to and use of the EatHealthy mobile application ("App") provided by Samuel Otten ("we," "us," or "our"). By downloading or using the App, you agree to these Terms.

1. The service

EatHealthy helps you log meals and view estimated nutrition information using AI-powered photo analysis. The App is intended for general wellness and informational purposes only.

2. Not medical advice

EatHealthy does not provide medical, dietary, or professional health advice. Calorie and macro estimates are approximations and may be inaccurate. Always consult a qualified healthcare provider before making significant changes to your diet, especially if you have medical conditions, allergies, or specific nutritional requirements.

3. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you should use the App with a parent or guardian's permission.

4. Acceptable use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, scrape, or abuse the App or its AI services
• Upload content you do not have the right to use
• Interfere with the App's operation or security

5. AI-generated estimates

Nutrition values are generated automatically from photos and may be wrong. You are responsible for reviewing and editing entries before relying on them. We make no warranty as to accuracy, completeness, or fitness for a particular purpose.

6. Intellectual property

The App, including its design, Sprout mascot, and software, is owned by us and protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

9. Termination

We may suspend or discontinue the App at any time. You may stop using the App by deleting it from your device.

10. Changes

We may modify these Terms at any time. Material changes will be reflected by updating the "Last updated" date. Your continued use constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the United States and the State in which the operator resides, without regard to conflict-of-law principles.
